Lawsuit Filed On Behalf Of Bicyclist Injured In Dooring Settled On Eve Of Trial

The lawsuit stemmed from injuries the bicyclist sustained when the rider was doored while bicycling in a marked bike lane in Chicago. The lawsuit was settled for $80,000.00 on the eve of a pending jury trial in the Circuit Court of Cook County. 

The total settlement of $80,000.00 provides the injured bicyclist compensation for the approximately $15,000.00 in medical expenses incurred as well as an additional $65,000.00 for pain and suffering and the loss of a normal life the bicyclist experienced as a result of the injuries. “Loss of a normal life” is a compensable damage under Illinois law that is defined as “the temporary or permanent diminished ability to enjoy life,” and “includes a person’s inability to pursue the pleasurable aspects of life.” Examples of a loss of a normal life include difficulty with sleeping, enjoying hobbies, or even something as simple as an interruption of your regular social life.

The act of "dooring," where a motorist opens their vehicle door into the path of a bicyclist, is specifically outlawed in Chicago. Section 9-80-035 of the Municipal Code of Chicago states:

"No person shall open the door of a vehicle on the side available to moving traffic unless and until it is reasonably safe to do so, and can be done without interfering with the movement of other traffic, nor shall any person leave a door open on the side of a vehicle available to moving traffic for a period of time longer than necessary to load or unload passengers."
